         Information We Collect

• Welcome to Iyzil! These Terms of Use (“Terms”) govern your use of the Iyzil mobile application (“App”), provided by Iylus Pvt. Ltd, a company registered in Pakistan (“Iyzil”, “we”, “us”, or “our”). By accessing or using the App, you (“User” or “you”) agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

• (a) Eligibility: You must be at least 18 years of age or the legal age of majority in your country of residence to use the App. By accessing or using the App, you represent and warrant that you are eligible to do so.

• (b) License: Iyzil grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use only. You may not use the App for any other purpose without the prior written consent of Iyzil.

• (c) User Conduct: You agree to use the App in compliance with all applicable laws, regulations, and these Terms. You further agree not to:

• • Use the App for any illegal, fraudulent, or unauthorized purpose.
  • Interfere with or disrupt the operation of the App or the servers or networks connected to the App.
  • Attempt to gain unauthorized access to the App or any part thereof.
  • Use any automated means, including bots, scripts, or spiders, to access, monitor, or interact with the App.
  • Upload or transmit any viruses, malware, or harmful code to the App.
  • Engage in any activity that could damage, disable, or impair the App or its functionality.
  • Share or disclose your account credentials or allow anyone else to access your account.
  • Use the App in any way that violates the rights of others, including their intellectual property rights, privacy rights, or any other rights.

          Account Registration

• (a) Account Creation: In order to use certain features of the App, you may be required to create an account by providing accurate and complete information about yourself. You are solely responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

• (b) Account Verification: Iyzil may require you to verify your account through a verification process, such as providing a valid email address or mobile phone number. You agree to provide accurate and up-to-date information during the account verification process.

• (c) Account Suspension or Termination: Iyzil reserves the right to suspend or terminate your account, or restrict your access to the App, at any time and for any reason, without notice or liability, including if you violate these Terms or engage in any conduct that Iyzil deems inappropriate or harmful to the App or its users.

         Payment and Cancellation

• (a) Payment: If you subscribe to the Basic Protection Plan or Premium Protection Plan, you agree to pay the subscription fee as indicated in the App. Payment may be made through the App Store or Play Store, and you are responsible for all applicable taxes and fees associated with your subscription.

• (b) Automatic Renewal: The Basic Protection Plan and Premium Protection Plan are automatically renewed on a monthly basis unless canceled by you. You authorize Iyzil to charge your chosen payment method on file for the applicable subscription fee.

• (c) Cancellation: You may cancel your subscription at any time through the App Store or Play Store. If you cancel your subscription before the end of the current billing cycle, you will not be refunded for any unused portion of the subscription fee.

         Intellectual Property

• (a) Ownership: The App, including its content, features, and functionality, is owned by Iyzil and is protected by intellectual property laws, including copyright, trademark, and other proprietary rights. You acknowledge that Iyzil retains all right, title, and interest in and to the App and its content.

• (b) Limited License: Iyzil grants you a limited, revocable, non-transferable, and non-exclusive license to use the App for your personal, non-commercial use only, subject to these Terms

• (c) Prohibited Use: You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the App, or use the App for any purpose other than its intended use without the prior written consent of Iyzil.

         Privacy

• Your privacy is important to us. Please review our Privacy Policy, which is incorporated by reference into these Terms, to understand how we collect, use, and disclose your information.

         Disclaimer of Warranties

• The app is provided on an ‘as is’ and ‘as available’ basis, without warranty of any kind, express or implied. Iyzil disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. Iyzil does not warrant that the app will be uninterrupted, error-free, or secure, or that any defects or errors in the app will be corrected.

• Limitation of Liability 

• To the maximum extent permitted by applicable law, iyzil shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the app, even if iyzil has been advised of the possibility of such damages.”

         Indemnification

• You agree to indemnify, defend, and hold harmless Iyzil, its officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or in connection with your use of the App, your breach of these Terms, or your violation of any rights of another person or entity.

         Modifications to the App and Terms

• Iyzil reserves the right to modify, suspend, or discontinue the App, or any part thereof, at any time and for any reason, without notice or liability. Iyzil also reserves the right to update or modify these Terms at any time, and your continued use of the App after any such changes constitutes your acceptance of the updated or modified Terms.

         Governing Law and Jurisdiction

• These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Pakistan.

         Entire Agreement

• These Terms constitute the entire agreement between you and Iyzil regarding your use of the App and supersede all prior or contemporaneous agreements, understandings, representations, and warranties, whether written or oral, regarding the App.

         Severability

• If any provision of these Terms is found to be invalid, illegal, or unenforceable, such provision shall be deemed severed from these Terms and shall not affect the validity, legality, or enforceability of the remaining provisions.

         Waiver

• The failure of Iyzil to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Iyzil in writing. Any waiver of any right or provision by Iyzil shall be effective only as to the specific instance and purpose for which it was given.
